Let Us Help You
If you or a loved one has been the victim of a serious personal injury, Abeyta Nelson Injury Law can provide the expert legal help you need. And the sooner we are asked to represent you, the more we can do for you. There are deadlines, called statutes of limitation, by which your claim must be brought. If your claim isn't settled or a lawsuit brought by this deadline, your claim will be barred. Generally, for injuries that occur in Washington, there is a three-year deadline, but some claims may require a shorter deadline.

Wrongful Death
We can't undo the pain caused by the death of someone you love, but Abeyta Nelson can help your family obtain the compensation you deserve for having lost something precious. A "wrongful death" occurs when a person dies due to the fault of another person, company or government entity. These deaths occur as a result of auto accidents, on the job injuries, farming accidents, and dangerous products.
Under Washington law, a claim for wrongful death can only be brought by the personal representative of the deceased person's estate, on behalf of the statutory beneficiaries. The most common beneficiaries are surviving spouses, children, and sometimes parents. In most cases, recovery can be made for loss of companionship, medical expenses, funeral expenses, loss of support, past and future lost earnings, and pain and suffering. Abeyta Nelson has handled many wrongful death claims for families over the years involving the death of a spouse, a child or a parent.
A wrongful death claim can't bring back a loved one, but it can recognize the value of the loss of the relationship with your loved one. If you've lost something precious, Abeyta Nelson can help.
Workplace Injuries
Job site and construction accidents can cause serious permanent injuries, and sometimes death. A Washington worker who is hurt on the job is entitled to benefits for wage loss, medical treatment, and rehabilitation services resulting from the work-related injury, but Worker's Compensation only covers some of the loss. Abeyta Nelson represents workers against parties responsible for on the job injuries. These can include a careless general contractor, a manufacturer of defective equipment that injured an employee, a landowner who provided an unsafe environment, or an equipment operator who caused an injury. Abeyta Nelson can help you determine your legal rights.
Uninsured Motorists
When you are injured by another driver who does not have any insurance or does not have enough insurance to fully compensate you, your uninsured motorist coverage with your own company will provide a source of compensation for you. Technically, when the other driver does not have any insurance at all, you have an "uninsured" motorist claim, and when the other driver has some insurance, but not enough, you have an "underinsured" motorist claim. Both are often referred to as an uninsured motorist claim, or a "UM" claim.
We are often asked whether a person injured by an uninsured or underinsured motorist needs an attorney to help with a claim against their own insurance company. The answer is yes. Your own insurance company employs insurance adjusters whose job it is to pay out as little as possible, and to protect the insurance company, but not your rights. Talk to Abeyta Nelson before agreeing to settle any claim, including any claim with your own insurance company. Pursuing a claim will not cause your insurance rates to go up when the accident wasn't your fault.
Too many motorists in Central Washington carry the minimum liability insurance required by law or no insurance at all. If you or a family member are hurt in a car accident, your UM coverage may be your only source of compensation for medical bills, wage loss, and for your injuries. That's why it is important that you carry uninsured motorist coverage in sufficient amounts to protect you and your family. This coverage is so important that state law requires it be carried on all policies of automobile insurance in the same amount as your liability coverage.
However, all too often we see policies where uninsured motorist coverage has been waived. Don't let your agent talk you into waiving uninsured motorist coverage in order to save a little on your premium. Remember, this coverage protects your family and once an accident happens, it's too late. We recommend a minimum of $100,000 per person and $300,000 per accident of uninsured motorist coverage.
If you have been injured by an uninsured or underinsured driver, it's important to consult with us, even if you did not have UM coverage. Coverage for a vehicle you were riding in or coverage from another member of your household may extend to you. This is a highly technical area of the law and an experienced lawyer can advise you as to whether you have an uninsured motorist claim. Abeyta Nelson is here to help.

Drinking, speeding, and carelessness lead to boating accidents involving skiers, wakeboarders, swimmers and others. If you have been injured by a boat or jet ski, the attorneys at Abeyta Nelson can help you recover compensation for your injuries. Governmental Liability
When federal, state, county and city entities and school districts cause injuries, there are unique laws and special claim procedures that apply. Abeyta Nelson specializes in dealing with these complex issues and has successfully resolved many claims against government agencies.
Unsafe Premises
Property owners have a responsibility to keep their premises safe for persons who use their property, yet serious injuries often occur when property owners fail to maintain or repair their property. Abeyta Nelson has successfully resolved many cases involving falls and other liability claims against property owners such as businesses, government and private landowners who have failed to maintain their property in a safe condition.
Nursing Home Injuries
Residents of nursing homes are in a vulnerable position, dependent on care givers for almost everything. Although most nursing facilities provide good care and comply with federal laws in order to operate, nursing home neglect and abuse of the elderly and disabled is a widespread and increasing national problem. Abeyta Nelson is familiar with the complex state and federal laws, regulations, and safety requirements that govern nursing homes. We've used that expertise to successfully resolve injury claims by numerous elderly and disabled nursing home residents and their families.
School Injuries
Like other property owners, schools have a responsibility to keep their grounds safe, properly supervise, and to protect their students. Abeyta Nelson has successfully resolved claims against school districts in cases that ranged from inadequate safety surfacing on playgrounds to improperly anchored soccer nets, unsafe P.E. activities, unsafe equipment in shop class and inadequate student supervision.
Railroad Injuries
If you or someone in your family has been injured due to the carelessness of a railroad company, you may be able to file an injury claim to recover for medical expenses, lost wages, pain and suffering, and loss of enjoyment of life. Abeyta Nelson handles train/car accidents, railroad crossing accidents, and other cases involving a railroad's failure to use reasonable care. We know that railroad companies sometimes operate their trains in dangerous ways, fail to properly maintain their equipment, speed over unsafe stretches of track, or ignore warning systems and/or crossing signals.
Railroad workers are covered by the Federal Employer's Liability Act (FELA), not by Washington's workers' compensation laws. Under FELA, railroad workers can make injury claims against their railroad employers for on-the-job injuries. Employers can be held responsible for their employee's injuries if the employer fails to use reasonable care, commits safety violations, refuses to remove hazards from the workplace, or otherwise puts employees at risk.
Claims against railroad companies can be complicated and are often vigorously fought by those companies and their insurers. Abeyta Nelson works diligently to protect the rights of injured railroad workers.
Dog Bites
Vicious dog attacks claim numerous lives each year, and tragically, nearly half of all dog bite victims are children. Dog attack victims may suffer severe injuries leaving permanent and unsightly scarring, nerve damage, risk for infection, and other long-term psychological harm. A dog owner may be strictly liable under Washington law for damages caused by a dog they own. Abeyta Nelson has recovered compensation for many clients injured by dog bites.
Brain Injuries
Traumatic brain injuries, also simply called head injuries or concussions, occur when a sudden trauma damages the brain. Brain injury occurs when the head violently strikes an object, an object pierces the skull and enters the brain, or when the head is suddenly and violently jolted. The top three reported causes of brain injuries are motor vehicle crashes, firearms, and falls.
According to the U.S. Center for Disease Control and Prevention, approximately 1.5 million people in the U.S. suffer brain injuries each year. Of these, 280,0000 occur in motor vehicle collisions. Young adults and the elderly are at the highest risk of suffering a brain injury.
Common symptoms of brain injuries include memory loss, fatigue, headaches, visual disturbances, impaired attention and concentration, dizziness, loss of balance, irritability, depression, loss of smell, sensitivity to lights and sounds, mood changes, and getting lost and confused. These injuries are commonly overlooked initially and may not manifest themselves until weeks or even months later.
Abeyta Nelson attorneys have years of experience handling traumatic brain injuries. We know what to look for, and we know which medical experts are qualified to diagnose and treat this kind of injury. We work with our client's treatment providers, neurologists, neuropsychologists, speech therapists, and other specialists to be sure that our clients get the treatment they need to help them recover. When injuries result in permanent impairment, we work with a team of vocational rehabilitation experts and economists to determine what future treatment our clients will need in order to help them cope with the lifelong effects of a brain injury.
Spinal Cord Injuries
Spinal cord injuries are serious and can be life changing. This kind of injury is usually caused by the fracture of a vertebrae, the bones that encase the spinal cord, and that broken piece of bone causing damage to the spinal cord. These injuries can result in loss of sensation and motor control of the arms and legs. They can result in temporary or permanent loss of a person's ability to use their arms and/or legs. The loss of function can be total or partial.
Spinal cord injuries are among the most serious of all injuries. The losses may last a lifetime. Recovering fair compensation requires a law firm that understands the far-reaching effects of these injuries and how to quantify these losses. We work with rehabilitation medicine specialists, physical therapists, and occupational therapists to ensure that our clients get the kind of treatment they require.
We also work with a team of experts to quantify the amount of future treatment expenses, medical supplies, transportation needs, home modifications, and in-home care that will be required in the future - sometimes a lifetime of care. We also work with vocational rehabilitation experts and economists to determine the amount of lost earnings and what employment alternatives may be available to the injured party.
These past and future economic losses can amount to hundreds of thousands or even millions of dollars. It's our job to see that our clients are compensated for these significant losses, and, just as importantly, for the loss of quality of life that these injuries cause.
Handling spinal cord injuries involves experience, judgment, compassion, and the highest level of legal skill. Abeyta Nelson has been helping spinal cord injury clients for more than 30 years, and we'll be there for you or your loved one, too. |
